Client Terms of Service

By engaging Brick House Recruitment (“BHR”) for recruitment services, you acknowledge and agree to the following legally binding terms:

  1. Engagement: BHR agrees to provide candidate sourcing, vetting, shortlisting, and coordination services in line with the selected recruitment package. Engagement is considered active upon form submission, verbal commitment, or written agreement.
  2. Fee Structure: Placement fees are outlined in your custom proposal and are due based on the terms of your agreement (Contingency, Retained, or Monthly Support). You agree to remit payment upon successful candidate engagement, defined as verbal or written acceptance of an offer.
  3. Candidate Ownership & 12-Month Protection: If you hire, contract, refer, or otherwise engage any candidate introduced by BHR within 12 months of the original introduction—whether full-time, part-time, contract, or freelance—you agree to pay BHR the full applicable placement fee. This clause remains enforceable whether or not BHR is involved at the time of hire.
  4. Non-Circumvention: You agree not to directly or indirectly circumvent BHR by soliciting or engaging any candidate introduced by BHR without BHR’s knowledge or outside the recruitment process. Any such circumvention will result in the full placement fee being immediately due.
  5. Replacement Policy (If Applicable): If a replacement guarantee (e.g., 30 or 45 days) is included in your proposal, BHR will make reasonable efforts to replace the candidate one time only if the candidate resigns or is terminated for cause within the guarantee period. Refunds are not provided unless explicitly agreed in writing.
  6. Confidentiality: All candidate profiles, notes, and materials shared by BHR are proprietary and confidential. You agree not to share candidate data with third parties without BHR’s written consent.
  7. Dispute Resolution: In the event of a dispute, both parties agree to first attempt resolution via good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration in North Carolina.
  8. Governing Law: These terms are governed by and construed under the laws of the State of North Carolina.
